New reporting requirement when (re)taking temporary unemployment

Employers who, as of July 13, are using the corona force majeure temporary unemployment scheme for the first time in their company, or are placing their employees on temporary unemployment again, must take into account a number of new information requirements.

What obligations rest on the employer?

At the latest on the day preceding the temporary unemployment, the employer must provide his employees with the following information:

  • The start and end dates of the temporary unemployment.
  • The number of days on which the employees will be placed on temporary unemployment, and if applicable, the number of days on which the employee will be required to provide performance within this period.
  • The formalities that the worker must complete to obtain benefits (usually submitting a form to the Auxiliary Fund).

What are the penalties for non-compliance?

If the employer fails to comply with this information requirement, the employer is required to pay the employee his/her normal wage for the days of temporary unemployment that precede such notification.
